MI Truck salesman Steven Cavanagh claims that he was unfairly dismissed, after being sacked by ERE Manchester when an order for trucks worth over .E1 million went sour.
During a two-day hearing, a Manchester Industrial Tribunal was told that 30 vehicles were ordered by Phillips Tankers (Bulk Powders) Manchester, and that the three vehicles actually supplied to the company were never paid for, allegedly having been used by Phillips until they were repossessed.
Cavanagh said that when he agreed to sell the vehicles to Peter Phillips, a director of the company, he believed that things were in order, that finance was available and that he had no cause for concern. He was taken aback when he found that the vehicles had not been paid for. He made efforts to chase payment from Peter Phillips and the finance company involved, but was unsuccessful. When he was dismissed, he was not given a chance to put forward his side of things.
Director and general manager of ERF Manchester, Gary Rowlands, said he felt that Cavanagh had not ensured that payment would be available when the order was placed.
The tribunal has reserved its decision.
