Which of the following most accurately describes the problem?

• Lord Maxwell has resolved a dispute in the Court of Session between a whisky firm and a haulage contractor over assessment of compensation due for loss of a consignment by theft while in transit.

It was agreed that James Buchanan and Co Ltd, Devonshire House, London, was entitled to payment from Stewart Cameron (Drymen) Ltd, of £9900, the value of 289 cases of whisky and five cases of advertising material, after the whole consignment was stolen from a car park in Liverpool on July 13 1970, while being transported by the Drymen company.

There was a dispute over the basis on which interest at seven per cent was due to the purchasers on the damages. The defenders conceded interest was payable from the raising of the action in December 1971, but maintained no interest was payable from any earlier date. The pursuers claimed interest from January 11971.

While granting decree for the principal sum, Lord Maiwell made no award of interest for any period before the raising of the action.
