• When a vehicle examiner went to inspect the one lorry owned by Mr Charles Scamp, he found three serious defects which led to Mr Scamp's appearance before the South Eastern deputy LA.
The LA curtailed one vehicle for two months and refused an application for another vehicle.
And a Transport Tribunal heard on Monday that just before the inspection of Mr Scamp's lorry, it had been pulled from a bog by a tractor after an accident.
Mr Nicholas Hannah, for Mr Scamp, said that Mr Scamp ran a 25-year-old family business as an agent for Bowaters, cutting and carrying timber. His lorry was vital to his livelihood.
The vehicle is used for nine months of the year. Before the inspection Mr Scamp had lent the vehicle to his brother.
But he did not have time to read the explanatory note from his brother about the accident or correct the "wobberly" steering which the vehicle examiner found on inspection.
Dealing with the maintenance facilities, Mr Hannah said that although the system of maintenance was formerly not as well defined as it might have been, Mr Scamp now had maintenance carried out by Preston Coach Services.
After seeing record books, Tribunal president, Mr G. D. Squibb QC, adjourned the hearing for a week to enable Mr Hannah to obtain a confirmation letter from the garage.
