mThe obligation to park vehicles inside an operating centre applies to "authorised vehicles", said the Transport Tribunal. if the operator owns more vehicles than the maximum on the licence, the surplus cannot be treated as authorised vehides.

It directed Western Traffic Commissioner Christopher Heaps to reconsider his decision to curtail the licence held by John Weaver, trading as John Weaver (Machinery Transport), of Poole, from 12 vehicles and 10 trailers to six vehicles and six trailers, on the grounds that vehicles and trailers has beer parked elsewhere.

Jonathan Lawton, for Weaver. argued that the TC had given undue consideration to the parking of trailers that were not owned by him.

The Tribunal said it was clearly the intention of the legislation that vehicles subject to the act should be parked inside the operating centre. It appeared to the Tribunal that a man who owned 24 trailers z was authorised to use 12 co keep the remaining 12 wh ever he liked.

The Tribunal directed the to rehear the case, and said should make specific findings to whether any of the vehic and trailers parked outs Weaver's premises were autl rised vehicles under his licer at any material time, and if whether any action was justif in respect of such parking.
