Which of the following most accurately describes the problem?

• North Western Traffic Commissioner Martin Albu has not taken action against Fleetwood-based Tara Freight—but he wants to see a copy of recent accounts as soon as they are available. Albu also wants to see a contract of employment for the company's new transport manager.

The company holds an international licence for six vehicles and six trailers and appeared at a Manchester Disciplinary inquiry.

Company secretary and director Graham Hunt said that when he joined Tara Freight a Mr A Kitcher was running the company. He found out that Kitcher's own company had gone into liquidation, Kitcher had not informed the Traffic Area and was still using Kitcher Haulage's 0-licence. Hunt sacked Kitcher, took control and found a new CPC holder, Harry Savage, who had helped get the company back on to its feet.

Hunt said that when he first looked at the company in August 1993 it was in financial difficulty. He took over in November and put a great deal of money into the business. The vehicles were now all paid for and the company was showing a profit.

Tara Freight's other director was Andrea Lord, who ran the company until July 1993 with Mr and Mrs Flynn. Savage had not wanted to put his name forward as transport manager until after the present proceedings were over as he did not want to be responsible for the past transport manager's actions.

Until the financial situation was settled with Tara, the vehicles were put in the name of Olympic Freight and leased to Tara. One vehicle had now been transferred back.
