A Welsh haulier whose father had his Operator's licence revoked last March will have to watt and see if he is successful in his own bid for a licence.

The Welsh Traffic Commissioner David Dixon told Darren Jones that he was concerned that Tenby-based Damsarec was a "phoenix company", following the revocation of the licence held by his father George Jones.

The IC said that there were also problems concerning unauthorised use, an expired tachograph calibration check and difficulties over the issue of a summons.

Vehicle examiner Neil Thomas said that during a roadside check a three-axle trailer used by Damsarec, but belonging to George Jones, was found to have half its brakes not working. When it was presented for the prohibition to be lifted, the problems still existed and a further four defects were found.

Darren Jones told the TO that the company was involved in demolition, recycling and the haulage of scrap.

He said that his a director and the company secretary. His father had nothing to do with the business, although he did purchase scrap from him. He had bought the trailer, loaded with scrap, from his father and it had not been used since. He agreed that other members of the family worked for his father. mother was The TC pointed out that Jones father was shown as a director of the company from 15 September 2001 until he resigned on 19 March 211102, the day before the company's interim licence was issued.

There was also a connection with vehicles being parked at Pembroke, combined with Jones carrying scrap for his father and still living at home. Taken together with the prohibition imposed on the father's trailers, it seemed that the connections were closer than were being admitted.

The TC will announce his decision in writing at a future date.
