INCIDENT in which a lorry driver was convicted and fined taking away a vehicle without consent and using it whilst insured before Teesside magistrates had arisen out of a sunderstanding with his employers.

This was said before the irthern Licensing Authority rtram Foster at Stockton on es when the driver conmed H. Purvis of Thornaby pealed against the refusal of application to renew his v driving licence.

A. Maze for Purvis said the ;ts were that his employers owed drivers to take their tgons home but they were -bidden to use them over the New Year period.

Purvis had taken a mini-van home and when he had to collect his wife who had been ill from hospital he used the van. During the course of the journey he was involved in an accident from which the prosecution arose.

Mr Foster said he had received a letter from the employers stating that the incident was the result of a mis understanding between them and Mr Purvis. He was a reliable driver and they would be sorry to lose his services if the licence was not renewed. They felt the conviction and heavy fines imposed by the magistrates were sufficient punishment.

In view of the support of the employers said Mr Foster and taking into account the previous good record of Mr Purvis he would allow the appeal and grant renewal with a warning as to future conduct.
