LICENSING DRIVERS'HEARINGS O u R S licence for faked paperwor A Suffolk haulier who let his ..41 stepson use his Operator's Licence while sending faked documents to the Traffic Area Office has been expelled from the industry. Bryan Pearce, trading as JSTH, was called before Eastern Traffic Commissioner Geoffrey Simms at a Cambridge disciplinary inquiry.

Vehicle examiner Christopher Barnett said that during a maintenance investigation Pearce's stepson John Schultes gave the impression of being in charge; he had not seen Pearce since the mid-nineties.

Pearce, who held a licence for six vehicles, said he had begun as an owner-driver in Lowestoft in 1986, later moving to Northampton, where he currently lived. Around 1993 or 1994 he had begun to involve his stepson in the business, gradually taking a less active role.

He claimed that he remained as an active transport manager. although was not paid for the job.

Questioned by the TC. Pearce admitted that he did not know the registration numbers of any of the vehicles. He knew only two of the drivers by name and could not identify the principal customers.

He said the vehicles specified on the licence were registered to JSTH, or John Schultes; he knew that JSTH stood for John Schultes Tipper Hire.

Asked about apparent discrepancies between signatures on documents purporting to be his, Pearce conceded that of the 14 signatures concerned only three were genuine.

Revoking the licence and making a disqualification order, the TC said that serious cnminal offences had been committed. Pearce had even begun his evidence with a lie as he did not live in Northampton but in Lowestoft, 130 miles away having moved back there in 1993/1994.

He had probably had little direct contact with the business since 1996, the TC added, though it was likely that he was aware that John and Michelle Schultes were operating

a haulage business using his 0-lic Pearce had enabled an unqualified an censed operator to flourish for a nu of years.

Confronted with the forged docun and with compelling evidence that Job Michelle Schultes were the actual o and users of the vehicles, Pearce hat tinued to affirm his active involvemenl when it meant telling lies about he lived.
