Which of the following most accurately describes the problem?

ADUNFERMLINE firm of coach hirers and a party organizer were fined £.5 and £10 respectively at Dunfermline Sheriff Court, last week, in connection with the advertising of a private outing to Whitley Bay. Both pleaded guilty.

It was stated that the organizer, David Philip Sim, placed an advertisement in a newspaper: "Seats available on bus for Whitley Bay, leaving Dunfermline on July 14, returning July 21. Apply 16, Craigmyle Street." This was noticed by the authorities and the attention of the hirers, Messrs. Meldrum and Dawson, was drawn to it. The firm wrote to Sim telling him that because of the appearance of the advertisement, the coach would have to be cancelled. However, on July 14, the vehicle did leave for Whitley Bay and was stopped by the police. It was found that Sim was one of the passengers, but another man came forward and said that he was the organizer.

The coach did not belong to Messrs. Meldrum and Dawson, and later inquiry showed that it had been ordered by another company which had obtained it from yet another undertaking. , It was with Messrs. Meldrurn and Dawson, however, that arrangements had been made by the organizer. The driver's work ticket showed Sim to be the organizer.

Mr. I W. M. Smith, for the accused, said that Messrs. Meldrum and Dawson had pointed out that Sim could not advertise the trip and that Sim cancelled it. He submitted that Sim substituted his brother-in-law as the organizer and that the actual trip was virtually the same as the original, as no intimation had been given to other bookers of any cancellation.

When Messrs. Mcldruin and Dawson were approached again, they said that they could not provide a coach. Unfortunately, said Mr. Smith, the clerk in the firm's office did not know that the original trip had been cancelled and issued the work ticket with Sims name as organizer.
