A SMETHWICK-BASFD car transporter has had its licence cut from six vehicles to two,after an inquiry heard it had operated without a transport manager for seven months and failed to spot regular speeding and drivers' hours offences by one of its drivers.The firm's trailer fleet has been halved from four to two units.

Father-and-son team Alan and Jason Jones, trading as MIR Transport, had been called before West Midland Traffic Commissioner David Dixon at a Birmingham disciplinary inquiry Traffic examiner Helen Key stated that the company had operated without a transport manager since the nominated transport manager left in June 2004 following a dispute.

In October,a complaint was received about an artic, which was being driven by Jim Reid, speeding on the M5. Examination of tachograph records showed that since 1 August, when the speed limiter became defective. Reid had regularly driven his artic at up to 125km/h (78mph). There was no evidence that the speed limiter had been interfered with — it seemed to be a genuine mechanical fault, which the driver had taken advantage of.

Reid had admitted he was aware of the fault, but had not reported it. The tachograph charts had not been checked since August 2004, so the speeding had not been picked up.The charts also showed a number of hours offences by Reid, who was being prosecuted, as were the partners for permitting them.

Jason Jones said that all the charts had now been sent for outside analysis. He was unaware that Reid had a history of speeding because his father had checked Reid's driving licence. He was awaiting the results of his own CPC exam.

Cutting the licence to two vehicles and two trailers, the TC directed that the licence be revoked on 11 June, to give Jason Jones time to make a fresh application in his own name as his father,Alan, had now retired.
