Which of the following most accurately describes the problem?

• Western SMT Company failed in an application at Glasgow this week for a new series of tours starting from the new Erskine development near Glasgow Airport. Mr James Mack, traffic manager, said that Western was the main operator of tours in the area with some 410 tours from the area between Paisley and Greenock. It was the service stage operator in the area and already operated through Erskine. It proposed to give a complete service of tours to the new town which it regarded as being sufficiently important to justify such special treatment.

Doigs Tours (Greenock) Ltd was the objector and Mr James Law argued that Doig, with 86 tours from Greenock had a very positive interest in the area. Doig also operated through the Erskine area and had a new application pending which would give it two picking-up points in the new town area. It was indicated that there were 1000 residents now, with a prospect of 3000 next year and 10,150 by 1974.

Mr Law claimed that the application was premature and Mr Mack admitted that this was so.

Mr A. B. Birnie, chairman of the Commissioners, ruled that there was no case to answer. They did this because the applicant representative had himself indicated that the application was premature. They were being asked to set up a position for the future which they would not do. They did not of necessity reject an application because there was no customer evidence as happened in this case; the position was that they thought the application premature and rejected it for that reason.
