Which of the following most accurately describes the problem?

• A South London motor mechanic, Mr S. W. Mence, who has recently had a Class 2 hgv driving licence granted to him following an appeal to a magistrates' court, may soon face an appeal by the Licensing Authority in the High Court against the grant.

Mr Mence applied to the Metropolitan Licensing Authority for a Class 2 licence on the grounds that he had been in the habit of driving a Class 2 vehicle during the period from February 2, 1969 to February 1, 1970, though the actual period covered was from February 2 to July 31, 1969, when he left the employer for whom he drove this class of vehicle.

He was refused a Class 2 licence, on the grounds that the period of his experience was two days short of the required six months. But he was granted a Class 3 licence, since he had been driving vehicles in this category for a longer period during the qualifying year.

Mr Mence appealed against the LA's decision to the Camberwell Green magistrates, who on February 11 upheld his appeal. Last week he was notified by the Metropolitan LA's office that, as a result of the appeal, he would be granted a Class 2 licence, and he was asked to return his licence for it to be amended. But at the same time Mr Mence was notified that the LA was seeking leave to appeal to the High Court against the magistrates' decision.
