Which of the following most accurately describes the problem?

• M J Giddings Farm Produce Limited of Colsden, near Bedford, has been given until the end of the year to show that it can operate on a satisfactory basis by the Eastern Licensing Authority John Mervyn Pugh.

The company holds a licence for seven vehicles and five trailers and it had been called to disciplinary proceedings in Cambridge in view of convictions for drivers and tachograph offences.

Evidence was given by a traffic examiner that in April the company had been convicted by the Bedford magistrates of seven offences of failing to use a tachograph correctly and one offence of permitting a driver to exceed the hours limits, being ordered to pay fines and costs totalling 2590. At the same court one of the company's drivers Colin Everall has been ordered to pay fines and costs totalling .2510 after admitting five offences of falsifying tachographs, four of excessive hours and one of taking insufficient rest. Enthusiasm

For the company it was said that the offences had arisen because of Everall's keenness and enthusiasm to get the work done. He has been given a number of warnings but the company has not dismissed him because he is a good, safe driver who looks after his vehicle.

Prematurely terminating the licence so that it expires at the end of December instead of on October 31, 1987, Mervyn Pugh said that when the licence fell due for renewal it would be considered at a further public inquiry and should there be any further breaches of the regulations during that period he would seriously consider either revoking the licence altogether or reducing the number of vehicles the company was authorised to operate.
