• Despite strong opposition from local residents and Test Valley Borough Council, BKP Scott-Healey Limited has won some alleviation of the environmental conditions imposed on the company's licence in April, 1985.

The conditions then imposed on the licence, which authorises the operation of 15 vehicles and 11 trailers from Embley Park, near Romsey, included a limitation on the hours of operation to between 7.30ain and 6pm Monday to Friday and 7.30 to 12.30 on Saturdays.

Complaints were received between June and November, 1985 that the time conditions were being breached by the company and at the beginning of the year it lodged an application to vary those conditions to read Mondays to Fridays 6.30am to 5pm and Saturdays 6.30 to lpm.

Evidence was given by Mr Scott-Healey that since the last hearing the company's business commitments had increased. In order to serve its customers and survive financially its vehicles needed to be at certain places by 7am or thereabouts. He maintained that the proposed change in times would have no adverse environmental effect, and indeed would alleviate the alleged traffic congestion between 7.30 and 8am. He had tried to find an alternative site but the council had refused him planning permission. The present restrictions meant that the company's financial position would decline. In order to generate sufficient turnover the vehicles had to be kept fully employed throughout the day. If it was going to be able to move eventually it needed to maximise its revenue.

In his decision South Eastern Licensing Authority Ran dall Thornton said that if the application were granted there would be some limited effect on the environmental conditions; the noise of vehicles leaving the site between 6.30 and 7.30 would in all probability disturb the sleep of the residents. However, he had to balance the interests of the objectors and representors with those of the company.
