Which of the following most accurately describes the problem?

THE tachograph in a lorry came to the aid of a driver last week when he was summoned at Kirkby Stephen Magistrates' court in North Westmorland for speeding.

The allegation, which William Rutherford, self employed, of Whitfields Drive, Richmond, denied, was that he drove at 52 55mph when checked by a police motor patrol.

However, Rutherford produced to the court his tachograph record which showed his speeds on the journey never exceeded 50mph but were between 30-40 mph. and the case was dismissed.

Rutherford was awarded £22 costs.
