lant's business had not increased in the past year despite full employment of its fleet—was advanced by C. E. Jauncey, for T. C. Brown and Co. of Dumfries, -appealing against the refusal of the Scottish Licensing Authority to grant art A licence for one additional vehicle of tons.
The firm was unsuccessful in 1962 when it applied for three extra vehicles and again in March, 1963, when its application was based on the grounds that business had not increased to the same extent in 1962 as in 1961. The Authority had refused the application, contending that some inconvenience resulted from return loading. Mr. Jauncey submitted that it was irrelevant that no applicant should be asked to forego the advantages of return load 'traffic. An applicant should not be expected to ditch part of his return load traffic simply to satisfy his outgoing customer, he said.
