By Chris Tindall TOO MANY hauliers and drivers are failing to comply with drivers’ hours legislation and are leaving themselves “wide open to prosecution” , according to a tachograph consultancy.

The warning from Alan Brys, founder of Farnsworth Consultancy and an ex-police oficer that specialised in tacho offences, comes after the publication of a VOSA report last month revealing that drivers’ hours abuses top the list of the most common prosecutions.

Brys says many operators don’t fully understand the legislation, and are allowing junior ofice staff to simply print off reams of tacho unit reports in the belief that this is enough to avoid prosecution.

He says companies are undertaking no analysis of their tacho charts and checking for things such as drivers’ start and inish times, sickness and holidays.

“It’s not conined to smaller companies and it’s not just rogue hauliers being prosecuted. “It’s decent, hard-working companies trying to do their best but they don’t have the knowledge to do that correctly.” VOSA disputes the scale of the problem: “Our most recent random leet compliance survey shows an extremely low non-compliance rate when it comes to tachograph records. Most operators we come across do a good job.”
