Which of the following most accurately describes the problem?

wagon on a vehicle covery — just a tow back on a bar. As e broken-down vehicle was unattended, had to send a mate to steer it. This an had an hgv driver's licence for the ass of vehicle being towed, but was this fact necessary; could not any driver have one? I have looked at the new regs and In find no direct ruling on this. The ?lice said that as far as they were ocerned no action would be taken if an

attendant without an hgv driving licence was used. Could you tell me what regulation covers this?

A Section 84(1) of the Road Traffic Act 1972 requires a person driving a motor vehicle on a road to be in possession of a licence to drive that class of vehicle. Section 190 defines a motor vehicle as a "mechanically propelled vehicle".

But a vehicle being towed does not conform to the definition of "a mechanically propelled vehicle" and the "steersman" does not, therefore, need a driving licence of any description.

It should be noted, however, that in one particular instance, a person who steered a van while it was being pushed by another was held to be the "driver".
