Mr G. H. P. Beames, representing the npany, said that Mr Stainier had resigned I a new company had been formed in gust 1972. Mr Stainier's wife now acted secretary and director of the company, ich had been operating on an interim :rice since October last year. A qualified nsport manager had been appointed and the vehicles were in a satisfactory tdition. Mr Stainier was now neither a ireholder nor official of the company and I no say in its policy. The company was N earning a substantial income, Mr unes said.
Mr J. Backhouse, for the RHA, referred Mr Stainier's bankruptcy hearing on wary 12 this year and its continuation er this month and said there were some itradictory remarks to be examined from his statement there. He said that trading had continued between August and October last year without the firm having any 0 licence at all. There was evidence from the bankruptcy hearing that the firm had not been operating economically at all and Mr Stainier had not been earning enough from his haulage rates to pay for repairs, licensing, hiring and maintenance. The firm had incurred a loss year after year since 1966 and in the last year had doubled this to a total sum of £25,000.
Mr Beames claimed that the matter before the court was entirely a question of the new company and its ability to trade. Mrs P. M. Stainier told the court that the failure to obtain an interim 0 licence for trading between August and October was purely an oversight, for which on behalf of the company she apologized to the LA. Mr Hodgson commented that it would not be appropriate to continue without further financial evidence being presented and indicated that at the full hearing he intended to take the opportunity for the first time as LA to sit with an assessor.
Mr Backhouse, who said the RI-1A would issue a revised list of its objections at the request of Mr Hodgson, said one of the questions he would be asking was if the hours and pay to Mr Stainier complied with the Road Haulage Council Wage Recommendations.
