Which of the following most accurately describes the problem?

• The power, under Section 69, of the 1968 Transport Act, that can be exercised by an LA was questioned on Wednesday by a solicitor during a public hearing before the Metropolitan LA, Mr D.I. R. Muir.

Mr Hitchens, representing Texsol Ltd, of Romford, Essex, said that a letter from the LA related to a proposed public inquiry and asked the firm to appear before him under Section 69 4(b)2. Offences alleged in the letter included ones that came under the Theft Act 1968 as well as excise licence infringements, said Mr Hitchens, who submitted that it did not come within the power of the LA to consider the case under this section of the Act.

After a short adjournment Mr Muir decided not to proceed with the inquiry, although he did think that Section 69 4(a)2 would have been relevant for some of the offences.
