Which of the following most accurately describes the problem?

• "Drivers who are given a different vehicle every day cannot be expected to carry out exhaustive tests on the tyres each time", said Mr. S. Clarke, secretary of the Wolverhampton busmen's branch of the TGWU last week regarding a move to have regulations amended so as to clear certain classes of drivers of responsibility for the tyres on their vehicles.

The move—a resolution calling on the Minister of Transport to alter the law— followed an appearance in court at Wolverhampton of four bus drivers accused of having defective tyres. The court, accepting the argument that they were allocated their vehicles by garage officials. gave them all absolute discharges.

A police spokesman said that under the Motor Vehicles Construction and Use Regulation 83 a driver was held responsible for the tyres on his vehicle, but the firm which employed him could also be prosecuted for causing or permitting the vehicle to be used.
