Which of the following most accurately describes the problem?

• If holders of A, B, and Contract A licences have not applied for their operator's licence by next Monday they may be denied the right of the transitional arrangements. December 29 is exactly nine weeks before the day on which operator's licensing comes into effect—March 1. The Transport Act 1968 requires that applications for operator's licences should be lodged with the appropriate Ministry of Transport traffic area nine weeks before the licence is required.

Under the transitional arrangement applications from existing operators will not be published in Applications and Decisions nor will there be' any right of statutory objection. In addition they will require to satisfy the Licensing Authority on two points: that they are fit and proper persons to hold a licence and that they have satisfactory maintenance facilities. Only new applicants will require to show that they have made arrangements to ensure that drivers' hours are adhered to, that their vehicles are not overloaded and that they have sufficient finance.

Applications from holders of carrier's licences received out of time may be treated as new applications and in such cases the Licensing Authority may require to be satisfied on all five points before granting the licence. Whether or not such applications will be treated in this way will be left to the discretion of each LA.
