BIBBY DISTRIBIJTION has defended its actions after letting several former MRS Distribution drivers go just one week after the drivers were told their jobs were safe.

Following MRS being placed into administration on 6 August. two contracts previously operated by MRS were transferred to Bibby: one with corrugated sheetboard supplier Board24. handled by MRS's Preston, I,ancs and Coalville. Leics depots: and the other with steel drum producer Greif UK, run by MRS's Ellesmere Port. Cheshire and Burtonon-Trent. Staffs depots.

Prior to the transfer, MRS provided Bibby with a list of employees who were assigned, under TCPE regulations, to the two contracts

However, post transfer, Bibby tells CM that it discovered the list contained the names of all employees working at the depots in question and not simply the employees who were assigned to the Board24 and Greif contracts.

Bibby says:"Drivers were called into a meeting on 12 August.'lhese drivers were informed that Bibby Distribution had ascertained that they were not entitled to transfer to Bibby under TUPE as they were not permanently assigned to the transferring contracts."

The drivers were informed that they remained employees of MRS and should report back to MRS and its administrator KPMG.

Bibby's management team says it will be paying those drivers that have already performed work on the Greif and Board24 contracts on behalf of Bibby.

"Bibby Distribution is sympathetic to the drivers who did not transfer to Bibby under TUPE. However, due to the necessary speed of the acquisition. Bibby has done its upmost to secure as many jobs as possible."
