Guard said that a number of Bradwells staff now collect any material that blows into Alloy Steel Rods' premises. Attercliffe was an industrial area and there was always bound to be rubbish around, he said. Alloy Steel Rods itself burned rubbish once a week, thereby creating both smoke and sold.

Ryals Bradwell, the firm's proprietor, said he had been in business for 16 years. The practice was to hire out the skips, bringing the contents back to the yard to sort out any saleable items before the remainder was taken to the tip.

Guard argued that Alloy Steel Rods' complaint was more against the rubbish and was not in relation to the vehicles themselves.

The LA said that a prohibition notice had recently been imposed on one of Bradwell's vehicles and it was reported that the inspection records left something to be desired. In reply Bradwell said that he was currently only operating one vehicle.

Renewing the licence only in respect of two of the three vehicles applied for, Whalley directed that a further fleet inspection be carried out by the vehicle examiners within 12 months.
