A SUFFOLK OPERATOR, whose Belgiumregistered trucks were impounded by Vosa, a decision that was later upheld by Eastern Traffic Commissioner Geoffrey Simms, is now taking the former TC to the High Court for misfeasance of public office.
Banham and Romantiek versus Simms will be heard at the Royal Courts of Justice on 1 October.
Garith Banham established a company in Belgium to run trucks in the UK under cabotage regulations. Vosa impounded its seven vehicles, a decision that was upheld by Simms, then a Transport Tribunal and a Court of Appeal.
Banham is bringing this case against Simms, claiming he was acting beyond his powers as a TC when he made the decision.
Simms is defending the case.
