A COMPANY which created fictional wage slips to falsify tachograph records has dropped its appeal to the Court of Session, the Scottish High Court. Kilsyth-based Hazco Environment al S ervices' appeal was against a decision by the Transport Tribunal upholding revocation of its 0-licence and the disqualification of the company and its directors from holding or obtaining an 0-licence.

Scottish Deputy TC Richard McFarlane had disqualified managing director Samuel Torrens for three years and the company's other director,Suzanne Ganiett,for 12 months after hearing that Torrens had created false wage slips to cover the fact that its drivers had falsified tachogaphrecords.The company was caned before the DTC after a series of drivers' hours and tachograph offences In dismissing an appeal against the DTC's decision, the Transport Tribunal said that Torrens was responsible for ordering the men to do the work and knew what it involved. He was aware of the need for relief drivers and the consequences of not finding them. The falsifications were not an isolated event. It was unlikely that the drivers would have entered false names unless they knew they were going to receive payment.

The Tribunal said revocation was inevitable, as was disqualification. Three years for Torrens and the company was in no way excessive and the DTC's conclusion that Garnett should be disqualified for a year could not be faulted.
