A Cheshire international haulier whose company went into liquidation in a vehicle and trailer on his own account is successful. In the meantime he has the opportunity to present more information to the TC in support of his case.
Robert Ham had applied for a new international licence for two vehicles and two trailers before North Western Traffic Commissioner Beverley Bell at a public inquiry. Irlam, an undischarged bankrupt, was told by the TO that he had to have capital and reserves of 28,400 for a two-vehicle international licence.
However, bank statements showed that Irlam struggled to maintain this figure, even with a £9,000 overdraft facility.
!ham said he had been an owner-driver between 1994 and 1997 before forming Robert Ham International, which ran threi vehicles. The company had gone under witl a deficit of about 2110,000 because of cash flow problems.
He had decided to go back to being ai owner-driver but it was too late. Customi put the company into liquidation because o outstanding VAT and Ham himself war made bankrupt last year because he ha( given personal guarantees.
In August 1999 he had set up a freigh forwarding company, RI international, witl his wife Rita. He remained a director of the company until March 2000 when he and hii wife swapped roles because of his impend log bankruptcy The company was still beiN run by his wife.
Irlam said he only planned to operati one vehicle and one trailer. He had cus tomers in Italy willing to give him work an( knew freight forwarders he had worked fa in the past.
Adjourning the hearing until November, the TC said she was not satis fled with what she had been told and wal giving flair] the chance to provide moo detailed information.
