Though the premises had previously been used for the storage of vehicles, Smith maintained that that use had ceased in 1984. He maintained that a large oak tree made the access lane too narrow and unsuitable for use by heavy vehicles. He also complained of nuisance.

Dealing with concern about the possible fire risk from chemicals carried, managing director Cyril Forrester said that no more than 10% of the vehicles parked at Higher Heath would be loaded.

Granting the application Mr Jackson imposed conditions relating to the entrance and exit routes and on operating hours. He said that the proportion changed the local authority would no doubt be in touch.
