Which of the following most accurately describes the problem?

• The licence of Middlesbrough haulier A V Dawson, for eight vehicles and 30 trailers, has been renewed by North Eastern Licensing Authority Frederick Whalley — but only for 12 months.

The company had applied for renewal in respect of 45 vehicles and 65 trailers, but managing director Maurice Dawson indicated he would be happy with 10 vehicles and 45 trailers. An additional objection to the renewal of the licence from the Transport and Gen eral Workers Union was withdrawn.

Evidence was given by a vehicle examiner of 16 prohibitions imposed on the company's vehicles and trailers since April and of an unsatisfactory maintenance record in 1985.

He claimed there was evidence of the use of trailers before prohibitions had been lifted. In addition to the vehicle examiner's report Whalley also took into consideration a number of overloading convictions.

Dawson told the LA that the company's fleet had been considerably reduced and that had led to a large number of redundancies in September 1985. Maintenance and inspections were now contracted out to Cleveland Commercials, who had taken over the workshop premises and facilities.

Whalley said the company had exercised inadequate control over the loading and maintenance of its vehicles. Dawson's apparent attitude, that overloading was a problem that could not be overcome and had to be lived with, was unacceptable. In view of Dawson's previous history the LA had reservations about the success of the new arrangements and felt that the size of the present operation was beyond the company's capability to control properly.
