Lorry Confiscated for Customs Offence.

A King's Bench Divisional Court, last Friday, heard an appeal by the Attorney-General, on behalf of the Excise and Customs, against a decision of justices at Barking. It was stated that a man was found to have 'mixed petrol with kerosene in a petrolengined lorry, which he had obtained from the British Railway Traffic and Electrical Co. , Ltd., on a hirepurchase agreement. The man was heavily fined, the oil was confiscated and the magistrates were asked to forfeit the lorry to the Crown, in accordance with the provisions of the Customs Acts. They declined to make such an order, because the property of an innocent party was involved.

The appeal was allowed, with costs. Lord Hewart said the words of the Customs Consolidation Act, 1876, were that " the justices may proceed with the examination of the matter and, on proof that the goods were liable for forfeiture, may condemn the same."

It was admitted that, if the Customs authorities asked that the question of forfeiture of the goods should be examined, the justices must proceed, and he decided that, once an order for forfeiture was made, the justices had a duty to condemn the vehicle to the Customs authorities if they asked it. Any argument in mercy against such forfeiture was not within their province. It was always open to the Customs authorities to remit the vehicle to an innocent owner.
