Which of the following most accurately describes the problem?

• An entrepreneur who promised to set drivers up as hauliers and dropped his scheme three months later owing them £30,000, says they will have to take him to court to get a penny from him. Kevin Wilde of Linwood in Strathclyde says he will not voluntarily refund deposits the six would-be owner-drivers gave him to ioin his scheme because his family has been victimised since it folded in July. Wilde asked most of his recruits to pay £5,000 to work as a subcontractor to his business, Linwood Transport Services. In return he agreed to find a regular supply of work and pay £350.00 per week. Subcontractors would also have the use of a 38-tonner. He also told them they would own the tractive unit and trailer after two years. But in July he wrote to his subcontractors explaining that he could no longer employ them. Wilde says he had not won as much work as he had anticipated. Originally he says he had planned to pay them back in instalments.

Wilde was made bankrupt in January this year and set up Linwood Transport Services two months later. As a result of this his recruits are considering whether they have a case against him.
