Which of the following most accurately describes the problem?

• A Chertsey motor dealer, Grove Commercials, has been fined a total of £125 and ordered to pay £60 towards the witnesses' costs following contraventions of the Trade Descriptions Act.

Although the vehicle had been described as being in "first-class condition throughout", Dulverton magistrates heard, an examination of the vehicle revealed a faulty front-axle beam, worn engine cylinders and pistons, a worn rear axle and worn brake linings.

Mr S. E. J. Ridler, the complainant, said that he had bought the vehicle after seeing an advertisement for a 1969 tipper he particularly wanted. He said that he first became suspicious of the vehicle's 40,000 mileage which was claimed by the vendors when he found that the engine had been rebored. The charge was proved and the vendors were ordered to pay a fine of £100. A second charge, of falsely stating that the lorry had a capacity of 12 cu yd when in fact it measured only 11 cu yd was also found to be proved and the company was fined £25.
