• As a result of being found guilty on five charges of using tractor vaporising oil in commercial vehicles a Cheshire haulage company was called before the deputy North Western LA, Mr P. G. Hayward, in Manchester on Tuesday, under Section 69.
After hearing evidence which showed that the company, R. Atkinson Ltd, of Nantwich, had committed the offences accidentally, the deputy LA decided to take no action against its 0 licence authorizing five vehicles and seven trailers.
Representing the company, Mr R. P. Whitehurst, told the deputy LA that the company had been fined £5 for each of the five summonses. The offences had been committed b accident he said, when a driver had taken fuel from the wrong tank. He explained that R. Atkinson Ltd shared premises with an associated company, S. and G. Atkinson Ltd, an agricultural contracting firm, and it was for this reason that the oil was stored at the premises.
Giving evidence on behalf of the company. Mr K. D. Brown, a representative of HM Customs and Excise, said that the offences had been discovered by chance. Following an inspection of drivers' records and the mileage covered by the vehicles involved it appeared that an excessive amount of tvo had been used. He said that when he interviewed the five drivers four said they had taken their fuel from the diesel tank but the fifth admitted that he had taken tvo by mistake.
