The Midland "Red" Appeals Against Double Licence Conditions To0 late to be dealt with in our issue for last week, the appeal of the Birmingham and Midland Motor Omnibus Co., Ltd., against a licence condition imposed by the West Midland .Traffic Commissioners was held at the Ministry of Transport by Mr. R. H. Tolcrton. The condition was that passengers should not be picked up between London and l3anbury on a service linking London with Birmingham.

The appellant company submitted that this condition applied to tin area outside the West Midland Area and was, therefore, not one which could be imposed by the West Midland Controls

sioners, seeing that, in point of fact, the Southern Commissioners had approved the licence without making this stipulation. It was contended that the backing of the Southern Commissioners ought to have priority and that the whole point was one of considerable importance, because, unless it were contested, great difficulties would certainly arise.

In the course of the bearing, Mr. Tolerton said that it would be helpful to know whether the Commissioners for the two areas had communicated with each other in the matter, and that he would refer to this point in submitting his report to the Ministel.

Objection to the granting of the entire licence, made by Mr. H. L. J. Steggall, proprietor of Autokoches, was heard at the same sitting, also the objection of the London Midland and Scottish Railway Co. The latter concern stated that, although it was financially interested in the Midland "Red" undertaking, it regarded long-distance road traffic as an interference with railway services.
