Which of the following most accurately describes the problem?

WHEN Sheffield magistrates heard a VII summons against Willie Stamp, a haulier, of Calvert Street, Sheffield, which arose out Of the alleged use of an ex-W.D. Dodge lorry with inefficient brakes; Mr. W. H. Waite, for the defence, said that if the charge were upheld, owners of 20,000 similar Canadian vehicles would have a claim against the Ministry of Supply for selling machines which did .not comply with the Construction and Use regu-lations.

Mr. D. F. Banwell, for the prosecution, said that the sides of the lorry had been built up by Stamp and that the hand brake was not able to deal with the extra weight which the lorry was able to carry. Stamp was fined £5. The driver, Cyril Stamp, of the same address, was fined 10s. for using the vehicle when the offence was committed.

A similar summons against the Boythorpe Haulage Co., Ltd., St. Helens Street. Chesterfield, was heard. This was dismissed when it was explained that the hand brake was effective when the brake drums were cool, although it was not when they were hot. The company was, however, fined £3 for permitting the use of an Austin 5-tonner which had built-up sides enabling a load to be carried that was too heavy for safety.
