A good word for the defendants was put in by Mr. Ouseley Smith, prosecuting solicitor, in a case at Wrexham, this week, in which Messrs. Whitley Brothers, of Wrexham, and three drivers were summoned in connection with hours offences.
Mr. Smith said it was only fair to mention that, compamd with the 37 cases involved, nearly 700 records were found to be in order. In addition, only one or two offences occurred on the same day.
The defence was that the men had gone home to tea with their lorries after finishing their work for the day, and had afterwards returned the vehicles to the garage. They recorded their time of return, but not the interval for tea consequently, it appeared that the men had worked for more than 5i hours continuously.
The prosecution asked for a penalty in respect of only one offence in each of the series, with costs on the other summonses. A fine of £8 18s. 6d. was imposed, including an advocate's fee of £5 5s.
