TRAFFIC commissioner (TC) for the West Midlands, Nick Jones, has praised the actions of a Shrewsbury haulage operator for keeping him informed about its financial problems.

At a public inquiry in September in Birmingham, the TC examined the conduct of George Marston, Sarah Marston and Brian Marston — partners in a transport business who were subject to personal bankruptcy orders.

Jones was told how following the orders the partners made a prompt application for a Regulation 31 order — a measure that allows certain third parties to take over an 0-licence. In this case, administrator Andrew Appleyard, of RSM

Tenon, took over the licence after the TC approved the order.

The TC said that due to the efficient and effective actions of the administrator, debtors are now likely to be paid and the family business can keep going.

"Too many entities that get into financial difficulties ignore the important legal provisions relating to communicating with the office of the TC and addressing the need to comply with operator licensing requirements," he added.

However, Jones explained that a new 0-licence application from successor business Marston Transport cannot be granted yet due to outstanding matters relating to auditing, roller brake testing and tachograph analysis.
