THIS case is brought as a matter 1 of principle," commented Mr. G. F. Nuttall, at Blackburn County Court, last week, representing Mr. Harold Ashworth, haulage contractor, Derby Street, Blackburn, who sued William Dixon, 42, Carluke Street, Blackburn, for loss of profits on the use of a lorry through defendant leaving his employment without giving the requisite notice.

Mr. Nuttall said that it was difficult to fill places of men in these days and there had been a tendency for employees suddenly to throw up their jobs. Hitherto, employers had not taken action to establish the principle. Defendant told plaintiff he would leave and he did so the following day. The man was engaged on a Government contract, carting ashes, etc., for the electricity station, and the loss of profit for the week was £15, The defence was that plaintiff released Dixon and that there had not been any wilful breach of service, as alleged. The ashes had a prejudicial effect on defendant's health.

A verdict for the plaintiff for ZS with costs was given. •
