Which of the following most accurately describes the problem?

From day one, agency drivers have the right to be treated no less favourably than employees in relation to collective facilities (unless the hirer can objectively justify this). This could include a canteen, car parking or transport to and from work. They must be informed of any vacancies as a comparable worker in a similar position.

After a 12-week qualifying period, they are entitled to the same basic working and employment conditions as a comparable worker. This includes bonuses, commission and holiday pay, but not sick pay or redundancy payments.

They are not entitled to a bonus for long service, should the employer offer one.

Certain breaks between assignments will pause the clock so the driver does not lose his qualifying period. The first of these is a break, for any reason, of no more than six weeks. Others include sick leave of up to 28 weeks, jury service of up to 28 weeks and time off related to pregnancy or maternity.
