Similar deficiencies were revealed by a maintenance investigation in July. Driver defect reports weren't available for inspection and the stated safety inspection interval was being exceeded. The initial failure rate at annual test since 2001 was 81.25 %.The past five years had seen sixteen prohibitions issued, including one marked 'S' because a brake defect had been neglected by the maintenance contractor. As a result, the TC revoked North's licence for five vehicles and three trailers.

North said he'd relied upon his maintenance contractor to maintain the system. He claimed there was a written driver defect reporting system, but could only produce four reports for the last three months and no tachograph charts or domestic drivers' hours record books for that time. He couldn't explain an instance of overloading and a defective speed limiter in June.

Asked about a failure to report convictions for the use of a vehicle and trailer without a valid test certificate, North said he was unaware of the need to report them. He also claimed mail had gone astray.

The TC said the documents produced demonstrated gaps in records and continuing flaws in the system. He considered North to have been evasive and not entirely honest in his answers.
