• A tanker driver who was hurt when another truck ran into the back of his vehicle has won .274,000 damages in the High Court. Derek Goldfinch suffered whiplash injuries and lost earnings because of persistent pain after the crash.
The accident happened in September 1983 on the A33 near East Stratton, Hampshire, when a Mercedes Truck driven by Kirk Howe of Gosport hit Goldfinch's vehicle. Goldfinch sued Howe and his employers, H T Hughes of Copnor, Portsmouth for negligence. He also claimed that leaking oil from a month-old Leyland coach had spread over the road and was partly to blame for the collision. The oil had caused Howe's vehicle to skid out of control, it was alleged.
Leyland was sued for negligence on the grounds that it had manufactured or sold a vehicle which was unsafe. In an out-of-court settlement Goldfinch, of Laindon, Basildon, won 274,000 with costs from the three,defendants, Howe, HT Hughes and Leyland Vehicles, of Uxbridge, Middlesex.
