Which of the following most accurately describes the problem?

• I am intrigued as to the basic facts the London Boroughs Transport Committee say we have ignored in our criticism of its hush kit plans.

You report LBTC as saying that there should be no problem for operators bringing their vehicles up to standard and that they have plenty of time to do so. But what standard? LBTC does not seem certain, referring to "current environmental standards" — whatever they may be. Our contention, in any case, is that by complying with UK and EEC requirements, the vehicles are up to standard.

The LBTC is also reported as saying that many manufacturers already fit kits to their vehicles and that operators should fit kits in line with makers' specifications. This is new to us as it does not tally with either the information given to us by manufacturers or the advice about specific vehicles given by manufacturers to our members. Indeed, I do not believe the LBTC knows, because most of the conditions it is imposing do no more than ask the operator to find out from the manufacturer what the position is.

It is for these reasons that we are advising and assisting our members in appeals to the LBTC Appeals Advisory Panel and will, if necessary, seek to challenge the legality of the LBTC's condition in the courts. J M Guttridge Regional Director Freight Transport Association
