Which of the following most accurately describes the problem?

• Ruling that the prosecution had failed to establish fraudulent intent, Mr Recorder Rankin, QC, allowed an appeal at Liverpool Crown Court, last week, by a Warrington haulage contractor against conviction and sentence at Warrington magistrates' court on a charge of fraudulently using an excise licence on June 17 last.

He was Robert Bradshaw, of Parr Street, Warrington, who had been fined £100 with £30 costs on December 10.
