Which of the following most accurately describes the problem?

THE Minister of Transport has dismissed an appeal by the Northern General Transport Co., Ltd., against a

refusal to grant a service between Craghead and Stanley. The material point at issue was whether the seating capacity of the vehicles to be used on the service should be limited to a certain figure.

The appellant contended, inter alia, that the Northern Traffic Commissioners' decision was contrary to Section 72 of the Road Traffic Act, 1930. It was submitted that the Commissioners have no power to limit the seating capacity of vehicles, except where road conditions make it unsafe to use larger machines.

The Minister expresses the view that, under Section 72, the Commissioners are entitled to consider-the question of seating capacity.
