A!lowing a vehicle to be sold with a misleading odometer reading may enhance its value, it could put the seller in breach of the law.
The Trades Description Act makes it an offence For the seller of a vehicle to allow his customer to be misled. If a vehicle which has covered 500,000 miles is Fitted with a replacement second hand tachograph showing 200,000 miles the buyer may believe it to be more valuable than it actually is. The seller may make no reference to whether this figure is accurate, believing it is the buyer's responsibility and to check a vehicle he is purchasing. Alternatively, the seller may have bought the vehicle not knowing if the information on the odometer is accurate but allows it to be sold without checking it as far as he is able. If the truth comes out the buyer may be able to reject the goods and reclaim his purchase price, or seek compensation. The seller may have committed an offence under the Trades Descriptions Act unless he can show that he took positive steps to check the information contained in the odometer is accurate.
