"If he has got proper facilities for the maintenance of his vehicles and he can satisfy all the other matters which the LA has to take into account, I have no doubt that the LA will grant a licence," said Mr Squibb.

Dismissing the appeal, Mr Squibb said it was not for the Transport Tribunal to investigate the matters of granting a licence that come before an LA — it was their job to say if he gave a right or wrong decision.

He said the appellant had produced only a letter from a garage saying that it was willing to carry out the inspections of a vehicle. "On that, the appellant asks us to say that this licence ought to be allowed to continue.

"In our view to ask us to do that is to take an entirely wrong view of the function of this court," said Mr Squibb.
