Which of the following most accurately describes the problem?

X have answered a query from a reader about having a minibus to take a club party to the Continent and the driving licence required by the driver. Although the question does not raise the question of payment for the trip by the club members, is it not the case that if payment is made by them, then the driver needs a psv licence?

AAny question of charging for the transport element of the trip, whether the charge is designated as a fare or not, would change the status of the vehicle and it would become a psv and a psv driving licence would be required if a charge was made. Section 117(1) of the Road Traffic Act 1960 defines a public service vehicle as a motor vehicle which is used for carrying passengers for hire and reward, which either is carrying passengers at separate fares or is not carrying passengers at separate fares, but is adapted to carry eight or more passengers. The vehicle in question would come under the second definition if any charge was raised to the club members for the use of the minibus.

Presumably the questioner would be making a charge for accommodation and meals involved but the hire of the vehicle would be paid for out of club funds.
