A Penrith haulier has had his Operator's Licence cut indefinitely from three vehicles and three trailers to one vehicle and one trailer over a series of maintenance and hours offences.

Rex Beatham, who has been in business for 35 years, was called before the North Western DTC Tom Macartney at a Leeds disciplinary inquiry.

Vehicle examiner Matthew Grieve said that over the past five years five prohibitions had been issued, including an immediate prohibition imposed on a vehicle presented for test with defective brakes. He detailed three convictions for tachograph and speed limiter offences.

Traffic examiner Peter Healey said that he had examined tachograph charts for two vehicles for last June. The charts for the vehicle driven by Beatham revealed four drivers' hours offences. The charts for the second vehicle, which was driven on 18 occasions by his son Gary, showed that there were four occasions when the regulated speed was exceeded and one occasion when the chart had not been properly inserted and no rest recorded.

Beatham said that the speed limiter had been changed on his own vehicle in October 2001, the vehicle having been in three times previously to have it repaired. The vehicle, which was given an immediate prohibition at the test station, had blown a brake diaphragm on the test rollers.

In regard to the drivers' hours offences, Beatham said that it was difficult to find anywhere to park at night now. One of the offences was caused when there was a fire at a service station.

He conceded that his maintenance facilities, which consisted of an open yard with a ramp, were not [deal. He agreed to have his vehicle inspected by an outside garage every two months between November and March.

Cutting the licence, the DTC said that Beatham had been in the industry a long time and might not be up to date with current practice.

The prohibitions demonstrated inadequate maintenance in the past. The speed limiter problems were even more serious and should have been detected by Beatham. His repute as a transport manager had been tarnished by his failure to exercise adequate control.
