Which of the following most accurately describes the problem?

COMPL/CATIONS arising from the joint operation by two concerns of an express service betweenHarrogate and 131ackpool were evidenced before the Yorkshire Traffic Commissioners, at Leeds, on Tuesday, when the West Yorkshire Road Car Co., Ltd., applied to take over the services of Seanor and Co., Ltd., Harrog-ate. The application was opposed by Messrs. William Pyne and Sons, Harrogate.

It was explained that for years Messrs. Pyne and the Seanor concern had been jointly operating a HarrogateBlackpool service. . When the Road Traffic Act was introduced, they applied for a joint licence, but were granted two licences, which were conditional on joint operation. The joint service was carried on under the name " White Coach Tours " ; other services, of the excursion type, were also advertised under this title.

For Messrs. Pyrte, it was submitted that although, in fact, there was not a

partnership between the two concerns, the effect of the joint arrangements was that of a partnership. The goodwill of the -businesses, it was argued, was wrapped up in the name "White Coach Tours," and none of the goodwill which had been built up under that title could be transferred to the West Yorkshire company, even if the transfer of Seanor's licences were sanctioned.

It was stated that Messrs. Pyne were prepared to acquire Seanor's services, for the same price as that which the West 'Yorkshire company had agreed to pay.

It was stated that the West Yorkshire company had offered to purchase both Seanor's and Pyne's services, but Messrs. Pyne refused the offer. In proposing to acquire Seanor's services, the " West Yorkshire" asked only for a licence with the same conditions as those of Seanor's licence. The Commissioners reserved their decision, as they also did tecently when the Seance's concern sought renewal of its licences.
