rAA SUCCESSFUL appeal to the Transport Tribunal in Edinburgh was made on Tuesday by lnverdon Transport Ltd., of Aberdeen. This followed a refusal by the Scottish deputy Licensing Authority. to grant two vehicles on A licence to replace two Contract A vehicles on the grounds that there was insufficient evidence to justify the change required.

Allowing the appeal, the Tribunal said that the appellants operated a fleet of seven vehicles on A licence and two vehicles on Contract A for Buchan Meat Products Ltd. A prima fade case had been made out for the applicant that Buchan had goods to be carried and wished the applicant to carry them. Buchan already had these facilities under contract.

The Tribunal had to consider whether the interests of others were affected by the proposed alteration. The deputy L.A. had come to the conclusion that the case made out for the applicant was not sufficient to outweigh the disadvantages to others. But there was little evidence of return traffic, and on consideration of the evidence it seemed to the Tribunal that the danger of abstraction from the respondents was so small that it did not justify refusing the grant.
